Privacy policy

Tikoon LLC (“Tikoon,” “we,” “our,” or “us”) owns and operates certain websites, including related subdomains; a mobile application (the “App”); application program interfaces; and other tools, technology and programs (collectively, the “Platform”). The Platform (including, without limitation, the App) together with all associated services are referred to as the “Services.”

 

As described in greater detail in the Terms of Use, the Tikoon Platform connects the excess food that restaurants may have with people in need of food at pantries and food kitchens. Volunteer Restaurants may donate food items by indicating on the Platform what food items are available for pickup. If a Partner desires to have a donated food item delivered to the Partner, the Partner will select the donated food items on the Platform (an “Order”). Once an Order has been placed, a Delivery Volunteer may choose to fulfill the Order by selecting it on the Platform. As described in the Terms of Use, an Account is needed to access or otherwise use the Platform or Services. 

 

We are committed to protecting the privacy of the Personal Data we collect and maintain, including the Personal Data of (i) Delivery Volunteers, (ii) personnel of Partners, and (iii) personnel of Volunteer Restaurants (collectively, “Tikoon Volunteers”), as well as any other users who access the Platform or Services (together, with Tikoon Volunteers, “users” or “you”). Your use of the Platform or Services constitutes your agreement with the terms of this privacy policy (“Privacy Policy”). If you do not agree with this Privacy Policy, you must cease all use of the Platform and Services. 

 

This Privacy Policy is incorporated by reference into, and is an integral part of, the Tikoon Terms of Use, available at [link] (“Terms of Use”). Any capitalized terms not defined in this Privacy Policy have the meaning ascribed to them in the Terms of Use. 

 

TYPES OF DATA COLLECTED 

 

I. Personal Data

 

While using the Platform or Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personal Data may include, but is not limited to: 

·      first name and last name

·      social security number

·      telephone number

·      email address 

·      postal address

·      driver’s license number

·      license plate number

·      car insurance information

·      photograph

·      age

·      gender

·      race/ethnicity 

·      physical characteristics or description

·      date of birth 

·      account information, such as username and password 

·      verification check information, including all information returned to us when conducting checks on potential and actual Delivery Volunteers, such as background, vehicle registration, driving history and insurance verification checks 

·      Ratings of you by other Tikoon Volunteers, Partners or Volunteer Restaurants 

·      Usage Data (defined below)

 

II. Usage Data

 

Some data may be collected automatically, either generated by your use of the Platform or from the Platform’s infrastructure itself (“Usage Data”). Usage Data may include information such as the type of device you use, your device’s Internet Protocol address (i.e., IP address), browser type, browser version, mobile operating system, the pages of the Platform that you visit and the time spent on those pages, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit the Platform, communications data (e.g., the nature and content of the communications you send on and through the Platform, chat logs and call recordings) and preferences information, such as language and delivery preferences. 

 

Usage Data may also include geolocation data, such as real-time location information, and delivery information, such as number of deliveries accepted and declined, delivery route information, time to complete deliveries and number of deliveries completed for Delivery Volunteers.

 

III. Tracking Technology: Cookies 

 

We use cookies to track activity on the Platform and store certain information. A “Cookie” is a small text file placed on your device containing the details of your browsing history on a specific website or platform. You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of the Platform. Unless you have adjusted your browser setting so that it will refuse Cookies, the Platform may use Cookies. 

 

Cookies can be persistent or session Cookies. Persistent Cookies remain on your device when you go offline, while session cookies are deleted as soon as you close your browser or cease use of the Platform. We use both session and persistent Cookies. 

 

HOW WE USE PERSONAL DATA 

 

We may use Personal Data for the following purposes: 

·      To provide, maintain and improve the Platform and Services, including to troubleshoot and monitor the usage of the Platform. 

·      To manage your Account, including to manage your registration as a user of the Platform. 

·      To maintain our volunteer records, including to send you acknowledgments, newsletters, notices and donation statements. Additionally, we may add you to our mailing list, unless you request otherwise. 

·      To contact you by email, telephone call, SMS, push notification or other equivalent form of electronic communication regarding updates or informative communications. 

·      To provide you with news, new opportunities and general information about our efforts, unless you have opted not to receive such information. 

·      To manage your personal ratings and your reviews of other Tikoon Volunteers, Partners and Volunteer Restaurants. 

·      For business transfers: We may use your Personal Data in connection with a merger, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets in which Personal Data is among the assets transferred. 

·      To enhance safety and security, including by running background checks on Delivery Volunteers and verifying users’ account information. 

·      For other purposes: We may use your Personal Data for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and improving your user experience. 

 

We may share Personal Data in the following situations: 

·      With authorized third-party vendors and service providers: We may share your Personal Data with service providers to monitor and analyze the use of the Platform or Services, to allow us to operate our business, or to contact you. From time to time, we may establish business relationships with other businesses whom we believe trustworthy and who have confirmed that their privacy practices are consistent with ours. For example, we may contract with third-party vendors to provide certain services, such as hosting and maintenance, data storage and management, and marketing. We only provide our third-party service providers with the information we believe is necessary for them to perform services for our benefit. 

·      For business transfers: We may share or transfer your Personal Data in connection with, or during negotiations of, any merger, sale of our assets, financing or acquisition of all or a portion of our business to another company. If your Personal Data is transferred as the result of a business transaction, we will provide notice if your Personal Data becomes subject to a different privacy policy. 

·      With other Tikoon Volunteers, Partners and Volunteer Restaurants: We may share your Personal Data with other Tikoon Volunteers, Partners or Volunteer Restaurants to enable delivery services (e.g., providing location data and ETAs to navigate food pick-ups and drop-offs, using location data to match available Delivery Volunteers to Partner Restaurants and Partners or sharing your phone number with another user to enable calling and text messaging during the period when an Order involving you and the other user is active).

·      With law enforcement: Under certain circumstances, we may be required to disclose your Personal Data by law or in response to valid requests by public authorities (e.g., a court or a government agency). 

·      With your consent: We may disclose your Personal Data for any other purpose with your consent.  

·      For other legal reasons: We may disclose your Personal Data under the good faith belief that such action is necessary to: 

o   protect and defend our rights or property;

o   prevent or investigate possible wrongdoing in connection with the Platform or Services;

o   protect the personal safety of the public or users of the Platform or Services; or 

o   protect against legal liability.

 

We do not sell Personal Data.

 

HOW WE STORE AND PROTECT PERSONAL DATA 

 

I. Data Retention 

 

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the Platform, or we are legally obligated to retain this data for longer time periods. 

 

II. Security

 

The security of your Personal Data is important to us, but please remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. 

 

CHILDREN’S PRIVACY

 

We not market to anyone under the age of 16. We do not knowingly collect Personal Data from anyone under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, or if you believe that we have collected Personal Data of any person under the age of 16, please contact us at info@tikoon.org so that we can delete such information from our records. If we become aware that we have inadvertently received Personal Data from a person under the age of 16, we will delete such information from our records. 

 

THIRD-PARTY PLATFORMS

 

Our Platform may include links to third-party websites, plug-ins and applications. This Privacy Policy does not apply to, and we are not responsible for, the Personal Data practices of third-party platforms. Any Personal Data collected by a third party will be governed by that third party’s privacy policy and not this Privacy Policy. UPDATES TO THIS PRIVACY POLICY 

 

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Platform once the change has become effective and update the “Effective” date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
